Dallas paper: Hawks should 'cough up' the 12th Man slogan

1:20 PM Tue, Jan 31, 2006 |

Now that we're worked up into a frenzy over this 12th Man trademark ridiculousness, here's what a Dallas columnist has to say about it: "One thing you can say about the Seahawks' use of the 12th man motto is it's not real imaginative. As representatives of a city that gave us the new business paradigm Microsoft, the Seahawks marketing department should be forced to cough up the slogan just on sheer lack of creativity. And they probably will, next Monday." (Thanks for the link, Ripley!)

Who cares what the Texan's think. They can't stop an entire city from hoisting up a flag with a 12 on it and cheering. They simply do not have the capability. So let's keep doing it and not give it a second thought.

    Will said:

Exactly Ryan, They Are All Bark With No Bite And As I Recall Seattle Won't Backdown To Noone Especially Some Texas Aggies Who Don't Know That Other Teams Use 12th Man, They Need To Look Online & Get More Information Before Attacking Seattle

    Stuart said:

Texas A&M Should cough it up and give the trademark to a real team and a real city. They will never no matter if they win in court get away with this. The 12th Man is here to stay. You know why because we control the laws in our state bitches.

    Earl said:

Seattle doesn't have the intelligence to come up with their own slogan so they have to mimic them Texans! Everytime you Seattle fans yell out the 12th man you're supportin' them Texans, not Seahawks. Just remember where the slogan came from and this one too ---> DON'T MESS WITH TEXAS!!!!!

Longhorn fan supportin' them Texas Aggies.

Texas Longhorns National Champions - Hook 'em Horns!!

How about changing it to the 12th "member" ???????? hey, get your mind out of the gutter....i meant like the 12th member of the team, member of the fan club, member of............what were you thinking????

    King Steve said:

Why am I not surprised by this. What next, are they going to trademark large bonfires that kill people? Hey A&M, why don't you start start worrying about your garbage football program and leave the good citizens of Washington state (who were smart enough to vote against Bush the last two elections) alone!

This is nothing more than an obvious, pathetic attempt to divert attention away from your putrid football team. You are going nowhere any time soon while your hated rival Longhorns are celebrating perfection.

If the court battle is won by Texas A&M, they will have to figure out a way to deal with the fans still using it, because we won't stop. What are they going to do, have us all arrested or sue us if we keep doing it? I don't think so. That'll be a waste for law enforcement to enforce this because there are better things to do than to put all of us in jail. All it means is that the jails will be full of fans when it could be full of people committing real crimes and getting money from people that aren't even committing real crimes if they sue us. Get real guys and gals.

    Anand said:

The term 'The 12th Man' has been used in the game of cricket for a really long time - definitely since before Texas A&M trademarked it in 1990 and 1996 but possibly since before they started to use it in 1922.

I don't know what they are whining about.

As a tried and true Texan (UT grad '79), I am once again embarrassed by the Aggies of A&M. Seahawk fans use of the 12th Man is in no way going to affect A&M's program...not in future revenue or reputation. For them to believe that A&M has a lock on such a widespread phrase is ridiculous! But so is the mindset of an aggie. There's a big world out there lil' aggie...Whine if you want....I'll be wearing my Seahawk's 12 shirt with pride (it's an added bonus that it upsets A&M!)
    Go Seahawks and Hook'em Horns!

Sorry guys. You can't patent the number 12. That's what we wave on our banner. That's what we wear on jerseys. Get over it. Why the hell would anyone in Seattle want to wear a Texas A & M logo on a jersey??? You can have your stupid logo.On with the 12. On with the fans rising up to the twelfth man call out. Don't worry Seahawks - We're behind you all the way screaming go 12th man. GO SEAHAWKS!!!!

    Howard said:

What this is all about is money. It's the marketing director who started this suit. The Seahawks offered these clowns $10K for the feelings and it wasn't enough, so now that we're in the Super Bowl they figure the time is right to try a little extorsion. See, this is set to go before a judge down there in Dogpatch that is an Aggie himself. Sorta sounds like the 2000 election. Hopefully we get a change of venue and an impartial judge, otherwise Judge Langley The Aggie probably sides with them, then say that for, oh a cool million, they'll "license" that to us. If we get a change of venue somewhere without a hometown "judge" it should go our way.

Just a few legal aspects of this court case for thought:

"Although it may sometimes be possible to take legal action to prevent the use of a mark in relation to products or services, this does not mean that trademark law prevents the use of that mark by the general public."

"Because the emphasis is on consumer protection, the user of a trademark does not "own" the mark in the same way that it may own a copyright. With some exceptions, the protection of a trademark is limited to certain markets, which can be defined by either the type of product or service, or even a particular geographic area."

"Once trademark rights are established in a particular jurisdiction, these rights are generally only enforceable in that jurisdiction, a quality which is sometimes known as territoriality."

"The party accused of infringement may be able to defeat infringement proceedings if it can establish a valid exception or defence (eg. comparative advertising) to infringement."

"Various jurisdictions have laws which are designed to prevent trademarks' owners from making wrongful threats of trademark infringement action against other parties. Where one party makes a threat to sue another for trademark infringement, but does not have a genuine basis or intention to carry out that threat, or does not carry out the threat at all within a certain period, the threat may itself become a basis for legal action."

It will be awhile before this issue can be classified as a done deal, so I am watching with much intrigue and fascination. Go Seahawks!

    Local said:

TAMU filed in a Texas court because the grievance must be filed in the court that holds jurisdiction over the party that has the grievance. If Seattle were attacking TAMU it would have been filed here in Seattle and work its way to a Federal Court. In this case it will work its way to a Federal Court which is located in New Orleans, LA. I would be more worried about that because if you think Texas is bad, LA. is even worse. :) If the Seahawks marketing team was a little more creative and done better research, this would not be happening right now. The guy that wants Texans to come up here for a fight.....smart move calling out a state where each household owns at least 2 guns. Might want to rethink that move. :)
Good Luck in the SuperBowl guys.

The CBC reports that Texas A&M University has convinced a Texas judge to issue a cease and desist order against the Canadian Football League because, unlike the NFL, the CFL actually uses 12 men on the field. "Obviously this infringes on our 12th Man copyright and should stop immediately," the TAMU Marketing Director was quoted...
All right, I made that up, but it shows how ridiculous this is getting. The Seahawks retired number 12 to the fans in 1984, 12 years before TAMU issued any copyright, and it has informally become known as the 12th Man, Seahawks version. Every team thanks their 12th man, but TAMU thinks they can bully anyone who uses the term. The 12 flag was added last year, but a 12 banner has been hanging in the Kingdome and now Seahawks Stadium/Qwest Field since then.
Besides, I don't think anything I've seen says "12th Man" verbatim - I've seen "Bring on the 12" or just "12". I do have a "Thanks 12th Man" button I received at the Indianapolis game, but they gave those away, and they didn't need to give away buttons to sell tickets...
    Please, get a Texas-sized life.

    Russ said:

There is a sign in Qwest Field that says "Home of the 12th Man". It just might have to come down if the case goes against Seattle.

Hey Anand and proud Texan .... we also beat the cowboys / remember ? and we should get a patent on their bon fire so they cant use it anymore and hurt themselves - how do you use the 12th man thing at basketball and baseball games ? see ! its a football thing / the Seahawks are a football thing / A and M is a agriculture and mining thing / go away ! youre drawing flies - GO SEAHAWKS and our 12th MAN / get ready for the BLUE THUNDER

    Ag07 said:

Ummmm..... Cedric, first off way to make a fool out of yourself. Making fun of a tragedy like the BONFIRE not bon fire. Secondly the 12th Man is the entire student body at ALL sporting events(not just football). And thirdly, A&M stands for Agricultural and MECHANICAL, not mining you freakin idiot. Know your facts before you go and open your ignorant mouth.

    Cedric said:

i wasnt making fun of the tragedy / i followed that when it happened and felt extremely bad for those students who died - what a shame ! tell me , how do ya have a 12th man in basketball or baseball ? that ! doesnt make any sence ! you sound angry .... are you related to tylerdurdin from other posts ? are you sure it isnt mining ? i think its mining ! mining sounds better dont cha think ? A and M stands for more than agriculture and mining , it stands during the whole game too / how stupid is that ? ya ll dont still do the bon fire thing do ya ? gotta go now GO SEATTLE SEAHAWKS !

    Ag07 said:

It sure seemed like you were making fun of it. 12th Man represents the entire student body, that is what we call our selves. Yes it started out for the football team in 1922 but has evolved into more than just sports. No mining sounds completely stupid. Yes we do stand during EVERY SINGLE SPORTING EVENT, soccer, baseball, basketball, volleyball, football, everything, to show our support, thats what supporting your team is all about. Win or lose, unlike seattle fans we support them. There is actually an off-campus bonfire that takes place(school not involved)

Obviously Texas doesn't have the intelligence to come up with anything original because you stole the term from cricket, which has been in use in cricket jargon since the mid 19th century.

I have one question, Why did it take 21 years to file?
The Hawks have been using the 12th man for longer, but that is when they retired the number 12.
Also someone stated that this is Seattle's first championship game????Wrong, both of our basketball teams have won championships. Also our college football team won a national championship in 1991. This whole thing was to get publicity on a superbowl that was not thiers. How pathetic...I am so glad that the Hawls beat both Texas teams!!!!!!!!!

For all you Aggies out there who say we shouldnt be using the 12th man thing because it is from Texas, you better not be doing "the wave" at any sporting event. That came from the UW right here in Seattle.

Does anybody here remember who the real "enemy" is? How about Pittsburgh? Okay i understand why those Aggies can be so upset becuase they haven't been recognized in the national spoylight for about five to six years. So now they think this is a chance to bring them back in yet do they know that the Seahawks have not made anything that says thier trademark 12th man like their stadium says. The Seahawks have a number 12 and we just say 12th man. That is why the Seahawks filed a suit also, to be brought in front of a Federal Judge instead of an Aggie alumni in some small court in college station Texas.
