Can Seattle ban weapons on city facilities?

At one point invoking Robert F. Kennedy's assassination 40 years ago, Mayor Greg Nickels on Monday announced he has signed an executive order that aims to ban guns on all city facilities, from parks to community centers. He and the city press release left out a few details.

While the press release says the executive order applies to firearms and guns, the actual executive order calls on the city to prohibit the possession of dangerous weapons, including firearms. What's a dangerous weapon? Who decides?

The state of Washington preempts cities, counties and municipalities from enacting and enforcing gun laws that are more stringent than those at the state level. The mayor touted during a press conference and reinforced the point in the press release that "a recent Washington Supreme Court case recognized that cities could adopt rules that regulate guns on city property. The case is Northwest Shooting Park Association v. City of Sequim (2006)." While that last point is factually correct, the mayor didn't point out the context. The case revolved around the city of Sequim granting a permit to a private group to use city property for a private gathering. If you read the Supreme Court's opinion, it states clearly, "the critical point is that the conditions the city (of Sequim) imposed related to a permit for private use of its property. They were not laws or regulations of application to the general public."

Critics say the mayor is overreaching and trying to exploit a loophole by issuing an executive order (which does not require City Council approval) so as not to violate the state preemption law. What both sides agree on is there will likely be a legal fight over the question of whether Seattle can ban weapons on city facilities. What do you think

Seattle has proven again and again that It can do whatever It wants. Pity the poor citizen when a week prior we were all forwarned that there is no money for public safety. Is this some kind of liberal population control?

Funny how the dems. like to think they can control what everybody does, but yet they want you to think you can choose for yourself. to all gun carrying people out there you need to speak up. protect you 2nd amendment. only 2 defining forces have givin up there lives for you and they are Jesus Christ and the American G.I. What is going on here? There is a shooting becuase a mentaly incompitent person with a gun fired 1 shot and it happen to hit 3 people at a public festival. According to the reports, this person had a concealed carry permit, but was on medication for a mental illness. That is the problem here, how did this person get or keep their permit after being diagnosed with a mental illness? The law abiding concealed carry permit holders of this state should not be forced to give up another right because the system failed to keep a gun out of the hand of someone who should not have had it. As far as I know, the only places in WA state where you cannot carry a firearm even with a permit are courthouses, liquor stores and bars, and schools. How can a city official change that because someone who shouldnt have had a permit to carry a gun did, and fired it? This is just another step towards our rights being taken away, dont let it happen people!

And what if someone else had a gun at the fairgrounds, they coulda disarmed this S.O.B. and god help us if they would've killed the yoyo. what about columbine? what about virginia tech? if someone had a gun and some training they could have saved many lives. That's the reason why these killers love schools, there's no one to fight back.

All gun owners who care about our second amendment rights need to find out when the public comment phase of Nickel's illegal scam is and attend the meeting en mass. That includes those of you in cities and municipalities other than Seattle. If we can be harrassed here you can be harrassed there if the Seattle police chief and the fat, dangerous clown get their way. There can be no greater example for citizens to protect their rights from those who would enslave us as this.
