I've worked on real estate stories and mortgage schemes before, but this is the first time I've come across what I now know is called "affinity fraud" or "affinity group fraud." These are schemes based on trust between the perpetrator and victim where the two share something important. Two common areas are shared religions and nationalities. Liza Bautista used them both. I mentioned in the story that Bautista is a leader in her church and often talked about her Christianity, but because of time limitations I couldn't really get into how much she used her beliefs to gain trust. I also didn't have time to mention how she almost exclusively worked her scheme through Filipinos. Liza is from the Philippines. When everything started to unravel and the truth began to come out, you can't imagine how devastated some of the victims were because of this broken trust. One of the victims was very reluctant to appear on TV because she was so embarrassed that a Filipino had done this to a fellow Filipino. And worse yet, she said, that a Christian had lied and cheated her. She was afraid this would make all Filipinos and Christians look bad. I assured her the story was focused on one woman who had done bad things. It would not be a negative story about Filipinos or Christians. She finally agreed to take part. But she was deeply hurt that a person she considered a sister by nationality and religion had taken advantage of her. Another victim had such a hard time believing anything was wrong with their transaction because they went to church with Bautista. She told me, "We didn't think that, especially someone from church would do something like that to someone who's a sister or a brother at church." Because of this bad experience, the family quit that church. Bautista didn't use these connections loosely. Through victim interviews and in reading e-mails and letters written by her, we found she aggressively used her shared religion and nationality to keep the scheme going. She was successful in encouraging many of the victims in the story to come to her church, and watch as she played the piano there. We heard a lot from Mary Pelayo in the story. Mary is married to a Filipino named Guy. Bautista often talked about that connection in their dealings. Mary Pelayo is the woman who thought they'd bought a home in Everett, but it really belonged to person they'd ever heard of before who lives in Shoreline. Bautista put the Pelayos through the wringer during the transaction. Closing dates were changed again and again, promises were made and not kept. Finally, when the family was led to believe the purchase of their home was all wrapped up, Liza wrote an e-mail. Here is an excerpt: "Praise God! Sometimes when things are difficult, God is truly testing our faith and our persistence. If we decide to give up and throw away the difficult time we have endured, especially when dealing with a seller who only pursues money in the place of a person's well-being, then we have lost the purpose of helping people. God Bless you. Thank you very much." I have learned from people who work in the law enforcement field, that "affinity fraud" is very common. Liza Bautista is an expert at it. This is the most disgusting thing I have ever heard of. As a mortgage broker, I am appalled that Bautista would use her position as well as the Action Escrow company to take advantage of these people. Thank you for uncovering this and hopefully more first time homebuyers will access information before hand so this will stop happening.
If people feel they have been a victim of financial fraud they can file a complaint with the Department of Financial Institutions, website http://www.dfi.wa.gov/. Also, the notaries are licensed and bonded. Hopefully someone is going to do something about them as well.
I just watched this story on the news. I have worked as a Mortgage Loan Consultant for eleven years. One one thing that I love about my job above everything else is helping people and making a difference in their lives. I could not imagine how these victims must feel. I really appreciate King 5 bringing this story to the public. Believe me these people involved with this scheme will pay, they will be looking at serious prison time and huge fines. This will not help the victims, but hopefully will reduce this type of greed in the future.
I was so amazed about this story because I am right in the middle of what I think is mortgage fraud, from a lease-to-own perspective. I have been searching for answers to keep me and my family from being out on the streets. We too were approached by a Filipino, Christian loan officer, who's daughter goes to school with my daughter, and he expressed an interest in helping my husband and I get a home. Because of our poor credit his company (Washington Loan Network) offered to have an investor purchase the home of our choice, based on what we could pay per month and the investor would pay the difference if the mortgage was slightly higher. We would have a lease agreement for a year, while they provide guidance in clearing up our credit so we can refinance the house in a year or two. Well two months after the process began, the house was purchased and we were given the keys to move in. We have been living in the house for two months and have not been given a lease agreement, nor been able to communicate with the investor. We have asked a lot of questions, but each time have been challenged on our faith in their willingness to allow them to help us get our home. We have tried to believe that these people really had the good benefit of me, my husband and three children in mind when they set us up with this "deal". We have gone from a verbal agreement, "while lease papers were being drawn up" when the house was in escrow, to pay a certain amount of money, to now being told that we have to pay $600 more than what we agreed to or move out of the house. When we accepted the keys to move into the house, on a Wednesday, we were promised that they would bring the lease papers by that weekend and collect our first and last month payment. Well when two representatives showed up to the house they told us the investor was having problems and wanted to sell the house. They told us our options were to buy the house, pay the full mortgage amount on the house (for which they would quit claim the house to us) or they would have another investor buy the house but we were not guaranteed to be able to stay in the house. In the meantime we found out that the house was not bought as an investment property, but owner occupied and that the representatives for the investor are probably not really paying the mortgage and possibly letting the house go into forclosure because we refuse to pay more than what we originally agreed to (which does not cover the full mortgage). After watching your show I am questioning if the investor really even exists or if someone's identity is being stolen. I do not know if this is making much sense, yet I would love to talk to someone further to get answers about what my family should do.
Questions unanswered are: Where and who are the real owners of these homes?
Is there no law against this and why was law enforcement not called in?
Is law enforcement and DFI checking into the mortgage company in which Lisa Bautista worked?
You described how the financing scheme worked but "property ownership" is accomplished by a transfer of title document such as a Warranty Deed. Did the victims have valid deeds to the property?

Using a professional, such as a real estate agent or mortgage broker, is important when making such a big financial committment and I hope the actions of an unprofessional person like this does not turn too many away from using one. This is the first time I have heard a horror story from having used one but have heard many horror stories of folkes getting cheated when they tried to sell or buy on their own.
Someone should check to see if she has also cheated other professionals that she would need to close these loans (like real estate agents or appraisers). I recently won a lawsuit against her for writting a bad check for professional services provided her that she paid for with her personal account (so I can't go after the company she worked for and she keeps changing companies so she is hard to track). Also what good is a judgement that you can't collect on. If this has happened to me I'm sure there are others out there that she has done this to.
I am wondering if Liza is working for several Mortgage Brokers at the same time? In the Cease and Desist Order, it states she used National Lending Corporation and Abacus Mortgage. It does not state Calibur Mortgage where she is/was originating loans with recently?
Anyway, I feel really bad for the victims. There has to be some way to help them financially. This type of fraud gives the rest of the mortgage industry a bad name. A few bad apples can really give us a black eye.
I appreciated your story on this predetory mortgage broker. My wife and I own a small insurance business and it infuriates me to see those who call themselves "professionals" taking advantage of hard-working people.
I'd like to recommend that you do a Part-two to this story, telling people what they can do to protect themselves from these type of individuals.
Even referrals from family friends can sometimes backfire. Checking the DFI website is a good start. Look under Administrative Actions. Also the Better Business Bureau. Do this BEFORE you decide to do business with anyone. Also, if it was a new business, ask cordially if they're new to the area and where they moved from. Chances are that they conducted business in another state. So check that state's records, too. Every financial business MUST have an entity that keeps them accountible for their practices. Check around, investigate,..ASK before you do business. The more informed the consumer, the more we are able to protect ourselves and drive dishonest people out of business.
I have been a notary for several years and have a pretty good idea of what laws apply to a notary. If I were those victims, I would also sue each and every notary (and the business) that illegally notarized these bogus signatures (in addition to Bautista). They should also have their notary status stripped as well.
Action Escrow HAD to be 100% involved in the sting, perhaps getting a kickback? I am a Notary too and I would never notarize a document without proper identification. Action Escrow did a disservice to these victims and put another black eye on the industry itself.
So, I hope the victims pursue these folks to the fullest extent of the law.
PARTNERSHIPS are subject to "affinity fraud" issues, as well. I got hooked into a bunk business partnership in which I am certain the Loan Agent, Mortgage Broker, Real Estate Company (and agent) and the Escrow Company were involved. Has anyone else had this experience with Foreclosure Group LLC?
I am both a RE agent and a loan officer. People like Bautista really give a very bad light to those of us who are honest and really work hard to help people.
I had clients in the past who did business with Washington Loan Network and Calibur Mortgage, separate transactions. The Washington Loan Network people are members of the Iglesia ni Cristo. Calibur Mortgage on the other hand I heard belong to a Christian Church. From what I understand, these people a team to complete their anomalous transactions, like, RE agents, escrow people, RE appraisers. Unfortunately, these crooks cannot be investigated unless the victims themselves file a complaint with the proper agency. And until someone actually files a complaint, these crooks will continue to scam other people.
I appreciate your story about Bautista and her affiliates, as well as the stories posted here by other people. The story of Mitch Gillen is pretty similar to my client's story with Washington Loan Network. So I have a good idea what Mitch is talking about.
I just wish we will find out what happens next to these scam artists, like, do they get prosecuted, do they go to jail, etc.
I am a bit concerned since I used Washington Loan Network as my mortgage broker when I bought my house 18 months ago.

Yes right now there is a lot going on in Mortgage fraud. I have heard that Washington Loan Network (WLN) is under investigation right now.
You people talking about their problems above. You better stop all dealings and turn them in before you get screwed over. They charge high fees and then stick them with interest-only loans fixed for a short time. I have even heard of them fraudulently turning in types of paperwork (bank documentation).
Whoever is doing business with them, (refi, purchase, rent, lease, etc.) they better stop and report all their doings to DFI. That is the only way it gets brought to light.
Thank you for bringing this story out in the open. My family is in the middle of a real estate scam. In our case, a real estate agent came to us and offered to be a friend and a business partner. Little did we know this real estate agent was just after all the money. We have an attorney involve however, for some reason it's taking too long. There are more people that were taken advantage of by this real estate agent and still afraid to talk. We don't know how to convince them.
The worse thing is, while the victims languish, that Liza is still originating loans but using someone else's name. This fraud scheme goes beyond just Liza Bautista, so, she is still earning $ originating loans, just not under her name. Another unscrupulous loan officer or mortgage broker is probably helping her out. How unfortunate.
I hope Lisa Bautista and her affiliates will get prosecuted soon and won't be able to leave out of the country.
this is a terrible thing to happen, i hope more people pay attention to this and heed the warnings of first time buyer and or bad credit scams.. what i dont understand is why is this woman not being arrested and detainded for the tremendous crimes that are not only terrible, but life changing for the victims involved. When you think about it just because what she did was not violent this women is damaging this system and our country and all under the banner of religion!! this is truely horrible what can we do immediately to stop people like her (bautista)?
There must be some way those deceived can get restitution. I think someone needs to look at the owner of Action Escrow because, as an attorney, he knows better than to fraudulently notarize documents. Is it possible he works with Bautista and this is a method they jointly use to defraud the public? I am guessing there are many other issues and concerns and a full investigation is owed to the public to protect others.
I had a really good experiance. We watched a video on www.mortgagewise.net that taught us all about predetory lending and how to protect ourselves. The guy who does this is Rick Bulman. First time buyer, with little credit and I was able to get a good deal and nobody could cheat me!

Liza Bautista was arrested and jailed. She posted bail and is out again.
Doing loans and laughing all the way to the bank. Really, really unfortunate. There should be a way to stop this.
I feel bad for the victim and Baustista need to go to jail along with her accomplices for fraud and identity theft.
the reputation of the filipino is getting bad because of people like her, using their position being christian. All of the victim should file a law suit regarding about the issue.
Last year i did a transaction w/ Lisa Bautista, I came too close to be a victim by her but with the help of friends and my real estate agent, i'm lucky that she didn't succeed.

I am puzzled as to exact facts of the scam: a broker arranged for a bogus purchase of real estate. The buyers signed what they thought were valid purchase documents. There was an actual person as "seller" whose execution of the seller's documents was forged. Notorization was done by actual notaries on forged signatures. The buyer took possession of the property. But: who really owns the property "sold"? Was there a real lender who paid funds into escrow? Where did the funds go? You said someone is liable for something anyway because of signing something - who and for what? You mentioned that personal information was taken and used(?) by the broker.
Were documents from the "transaction" recorded? Did the real owner give the access to the property? Does the real owner know what happened?
Was there a title report or pretty much no documentation. Did any money pass from anyone to anyone. I heard the story on both King and Kong but the mechanics of the fraud escaped me. (I understand the "affinity" part that made people trusting but beyond that, what happened?
Hi Im Ron H. I am a in the mortgage business and I am Cchurch of Christ member, but I am a honest person who does everything by the book and strive to really help people in anyway i can or possible rather it be mortgage, personal problems, school you name it. I feel its wrong to put down everybody who is in the real estate(mortgage business) and Iglesia Ni cristo members for previous or present concerns with people in the past. Being a member of the Church of Christ and in the business I dont represent and i repeat do not represent fraudulant activity or wrong doings to people and all I do is put myself out there to be a helper and have personal testimony from plenty of people who can bare witness to my kind and caring ways. So for you people who are trying to give church people and other people in the real estate mortgage business a bad name stop that. Its wrong and you can not judge or hold a grudge against everybody because of one or a few people. Please Keep my church's name out of your mouths.

So i think you need to clarify your facts before slandering me or my name because you will never see or hear about me doing such a thing. As a Filipino and a Christian, Liza's actions are a disgrace. She should be ashamed of herself. She deserves to go to jail for this and pay restitution to those she victimized.
And I agree, the broker and the notary are all in this together. They should all be prosecuted. Liza could have not executed all of this without their help. I wonder how much kickback they got from the transactions?
I don't know Liza personally, but I know of her. She lives in a very nice home and drives a luxury car. Now we know how she supports her lifestyle! Shame on her.

My name is Jeronimo Deleon, and I wrote the loan and helped Mrs Angela get in the home she is talking about. I am am absolutley shocked why you have made the remarks you have made, and would go as far now as letting the public know that what you are doing is taking advantage of the woman who bought that house as a investment property you need to stop stereotyping people, it seems really convenient that you have chosesn to express your griefs to the media when another church going philipino has been exposed of doing fraud in this business. I d not know how you came to the conclusion and guessed correctly that i attend a church with a large amount of philipino members, I am a proud member of the church of Christ, Iglesia Ni Cristo and will defend it with my life to the death, do not get my church mixed up in this hubbub of accusations and assumptions. I run my bussiness correctly and am prepared to work towards resolving this situation legally, Let us know what you are going to follow through on, you said you wanna get out, i can help you get out into somewhere else, you wanna stay, well then call us and let us know, so we can come to an agreement, you are a nice person and i remember how excited you were when you entered the home. I was happy for you so was my client. I was willing to accept Angela as a renter for her property because she was brought to the table by my colleague who i attend church with, both of us felt it was an oppurtunity to help someone who he felt he was friends with, so it was agreed she would be able to occupy the property, please note this woman Angela at this time is a friend of my friends. I feel Mrs Angela has been misrepresenting this situation to everyone, and is just trying to make a story and take advantage of us, as a result we will be seeking the consultaion of our legal advisor on how to handle this situation correctly and safely. It is true there are people who do bad things in this industry. but at the same time there are some of us who really do look towards helping people, Mrs Angela was given an oppurtunity to rebuild her credit, have as much time as she needs to do that and end up with a home she could call her own after her credit 's high enough to qualify her to buy the property. Now, we dont know whats going on, she is mad and is trying to accuse of things that arent true.

If this person is slandering you (Angela). What broker did you use to close the home with (mortgage broker)? Is that company in business now? If it isn't? why not? Has any of your companies that you have had dealings (closed loans) with been investigated in the last 4 months? If they are being investigated why are they?
I know you won't be able to answer all these questions to the fullest.
People please keep in mind they use their religion, nationality, whatever they can as a tie into getting you to trust them. The thing to do is educate yourself and make sure things do sound correct.

I just want to say that buying a home is a dream of many people and alot of Realtors do not try to help you buy a home they try to help put money in their pockets. They forget that the reason they get paid is by helping people, not taking advantage of them. Sadly to say these same "Bad Realtors" end up becoming "Bad Mortgage Brokers". I am a student and this story caught the attention of the people I am studying/training under. As a Realtor in training I feel bad, and yet i am at the same time, thankful to these Realtors, Mortgage Brokers and Loan Officers for doing bad business, so that i can learn first hand not what to do. Unfortuantely it takes something like this to happen before things are able to be changed. I know of clients who were represented by this company you all are accusing, and I can tell you first hand that they are happy home owners because of them. I can also tell you, that there was a group of people who ruined the reputation of this business, because they got greedy. Because of this, they ended their own careers, ruined business relations, and lost the trust of many people. And because of this are bitter and resentful to this day, and would do or say anything to implicate others. How these people can face themselves everyday in the mirror is truly amazing. I know for a fact as well, that several of you are using false names to write bad things above about the company who let you go for taking advantage of people. Remember what goes around comes around. You should be very careful of what you say and who you say it to, Have not you been investigated yourself. (food for thought)................

Does anyone have an update of what is going on with Liza Bautista?
I agree that we need to focus back on Ms. Bautista but we also need to help put make it clear that this is not just about one person. I read all of the responses to the blog and I am concerned that so many people are being hurt by this. It concerns me that anyone's family would be put out on the street because someone is money hungry and only looking out for their best interest. If notaries are signing off on false documents, why do they think they should be allowed to keep their licenses? If people are using Christianity and the churches they belong to scam people, why do they not think that they would not eventually be exposed? If Geronimo is responding to the Angela that posted the earlier blog, why didn't he give her a legitamite lease agreement? Why would he increase her rent and tell her to pay or move out? In his email, he is contridictary about wanting to help this "nice woman" but then making her seem bad for not wanting her family to be put into a sticky predicament. If you were legitimate in your dealings you should be following State tenant laws and serving her an eviction notice and if she still does not pay then you should be going to court.
On this whole blog there is a lot of information and no one really putting the pieces together and helping to bring resolution to the problems. I hope that the reporter will have a follow up to this investigation and the DFI will respond publicly.
Washington Loan Network helped me out when I was in need. For those people that complains about getting bad deals from that company, I just have one question. Why didnt you go to the bank and get your loan? I bet you, you got SH**ty credit huh? I went with them, because I dont have the greatest credit. If you pay high fees than normal, that is the payment for having bad credit. Good credit, good rates. Bad credit, crappy rates. This is America Baby, that's the way it works!! Live with it.
I THINK Susannah Frame NEEDS TO INVESTIGATE WLN SO WE REALLY KNOW WHAT THE TRUTH IS ABOUT THEM!
I hate to break into this argument between folks who think they've been wronged by whoever the company was, but there's a bigger issue here, I think: it's all too common for folks to use their religion (or maybe ethnic identity too, I don't know about that) to network business deals.
It's something I've seen in my church for years and years...and nobody ever seems to call it the indiscretion and/or fraud that it often turns out to be. Usually, the victims are ashamed or not willing to publicize their bad (usually very bad) experience in order to not attract unfavorable publicity to their fellow church members...and there's the shame: if only folks could realize that just because one shares the same beliefs (or professes to), it doesn't necessarily reflect badly on the religion, although I suspect that if someone is seduced via a religious relationship, they may not be eager to publicize that. But, again, that's the problem, and also suggests a solution: never, ever, ever, trust someone within your circle of faith or ethnicity any more or less than you might a person within your normal circle or business contacts. Anyone that would do this...sorry to say...pays an awful price for their bias as often as not.
Sorry to put the kabosh on this fun discussion, but I thought it needed to be said.
I totally agree, the scams are not based on religion or not necessarily based on race. Otherwise we would look at say the catholic religion; (with the number of their members) I am pretty sure that there is a bunch of people that committed fraud there. Or we would look at the Caucasian community (with the number of their population) and I am pretty sure there are a bunch of people that committed fraud that are Caucasian. So it is necessarily a certain race or religion that is doing this! I know... because it was mainly one family and their close friend and they did not all go to the same church. I can say a few of their man players in the company was catholic. And a few of their main players are not Filipino either. And for Liza she was the only one form her church and now her church is getting a bad rep also!
I posted this because I think it is not fair that people’s religion and race be slaughtered. Nor is it fair for the people that are doing good business, not be trusted because of the religion or race. We need to realize that there are people out there wit crooked minds no matter what religion or race.

I feel very bad for those families that Liza deceived...especially to the extent of what happened. But I do however feel I need to respond to the comments like those of Sonia's and Joe's and etc. who are making WLN look bad as a whole and to say that they all belong to a certain religion. I'm pretty sure NLC, Abacus, and Calibur mortgage companies would not want to be labeled as bad companies because of the doings of Liza Bautista. And I'm pretty sure there are very good people in those companies who work there and are negatively affected by the situation. And I'm sure the members at her church would also not want other people think their church is bad because of her. Just like in Susanna's blog an organization is not bad because someone in that organization did something bad. Hopefully airing Liza's story helped the public in some way whether it be that all of us need to be more cautious, educated, and not let our gaurd down. There is nothing wrong w/ going to a mortgage company, there's nothing wrong w/ dealing w/ people from your own race or religion...let's just face it, there are people like Liza Bautista out there...so let's just all be more careful. I have personally witnessed many notaries notarizing documents in real estate offices without the signor being present. Technically it can be done, so, trust is a big factor. Don't jump to conclusions that the notaries were in on it.
Hey, Liza Bautista is a female, Christian,
filipino, roughly 5'2", etc. Does this mean all females are bad? People at a certain height are bad? Are all filipinos bad? Are the companies she worked for bad? etc., etc.
My obvious point is there are bad people in all walks of life and, as consumers, we need to constantly be educating ourselves, especially when we are dealing with, for most, the biggest transaction, i.e. buying a home.
What I would like to see is that Liza gets punished for her crime immediately. As I sit writing this comment, Liza is out there enjoying herself and, most likely through her extensive contacts, profiting in some way originating loans. Other than making every mortgage broker and banker out there aware of her crime, how else can one stop her from originating loans through a colleague or another unscrupulous broker???? Any ideas?
For the record I don't know Liza or of her (until King5 introduced me to her). I am a filipino mortgage broker and a former Catholic (long story, I just hated giving money to a church that abused young boys...). Anyway, personally, I am really pissed at Liza Bautista because of how she took advantage of people, much less putting these victims in credit hell. She puts a black eye on the honest loan officers out there and the mortgage industry. Shame on you Liza Bautista. We all know you are reading this.

The worse thing is, while the victims languish, that Liza is still originating loans but using someone else's name. This fraud scheme goes beyond just Liza Bautista, so, she is still earning $ originating loans, just not under her name. Another unscrupulous loan officer or mortgage broker is probably helping her out. How unfortunate.

i wonder which mortgage broker she's submitting under....hmmmmmm. hopefully, a lot of these "greedy" loan people will now think twice, now that an investigation is under way. but then again, MONEY is a big factor in all of these so this investigation might not have any effect on them.

Kudos to the lender rep that denied doing a loan for Liza! That action right there is evidence that Liza is defying the Cease & Desist Order. So, what good is the Cease & Desist Order if Liza is still (even attempting) originating??? DFI, are you reading this?? More needs to be done sooner and I am for helping in any way in this fashion.

I closed a loan with this lender rep a little over a month ago. Now I know why the lender requested two pieces of ID from my clients when they signed at escrow. At that time I questioned why they asked for another piece of ID aside from the driver's license. Of course, because I am a Filipino doing a loan and they just probably want to cover all their bases because of what Liza had been doing. One bad apple sure will effect all of those hardworking LO's who are working by the book.
Like you, I am also for helping get those bad apples out of the way. By the way, the lender rep said Liza used her "faith" to befriend the her. They even prayed together.
Well, she will need to pray really, really hard. I see jail time on this one if she is proscuted properly.

Liza Bautista does not belong in the Church of Christ. Just because her race is Filipino and her religion is Christian does not mean she is a member of the Church of Christ. My family is a close friend of her and we know she is not in the church. You cannot blame a church for her actions because even though someone may be a faithful Christian and goes to church, its how the person wants to make a living in this life. Hello. I am a member of the Church of Christ (Iglesia Ni Cristo) and I go to the locale at Kent. Not only i am a member but i am a Deacon and my wife is a choir member and so are my kids. Liza Bautista is not a member of the Church of Christ. That is a fact. In the locale of Kent, Liza Bautista has no membership of the church whatsoever. If you have watched the video of Liza being caught on tape when she was going to her church in Tukwila, you can see that is not the Church of Christ. Liza Bautista goes to a church where they are renting space. As you can see Tukwila is far from Kent. The Kent house of worship is a much bigger church than a rental place. The quote she has said in the top is not a teaching that we members of the Church of Christ (Iglesia Ni Cristo) believe. We based every teaching in the bible. What Liza Bautista is doing is giving other churches bad names. First off in my line of work sadly enough I see at one point even the straightest Loan Officer, Broker, Notary, Escrow,appraisers and My Goodness the borrowers yes yourself forge, lie, alter, create, steal, borrow all on a mortgage loan before. I am one of these guys that make or break/prevents some dreams from coming true. Yes a mortgage underwriter. I have seen for the most part most of the schemes out there come across my table. Instead of everyone pointing at race religion and what Tom and Katie ate at their wedding you should be pushing WA state to pass higher barrier of entry and strict consequences against LO, Brokers, Notaries, "Mortgage Broker owned Escrows"(Yup you heard that right), and so fourth. Well guess what people? Loan Officers dont even need a High School Education to become your "Mortgage Specialist" they dont even need to take any formal training class. During the hight of the refi boom I had seen so many new L.O. that were working full time at BOEING or Microsoft and doing the LO thing on the side. Some of them didnt even know what a Goodfaith, TIL or ECOA were let alone handle your financial information. Good News is that L.O.'s will soon have a higher barrier of entry come next year with a test from WA.
The same goes for escrow notaries. I swear majority of them dont know what a lot of the documents they put in front of the clients really mean or they dont bother to explain or incorrectly do so. Of the people that posted above how many of you actually read through line by line of all the documents that were in front of you when you bought a house. I'm confident to say none because we are always rushed to sign everything on our lunch break just to close that deal.
Although I cant say that this problem all stems from an industry that is in need of shake up. Trust me it's not just WA state, there are many that are going through this. Ultimatly the borrowers will have to be the ones that realize and recognize that if it's to good of a deal then it may just be smoke and mirrors.

This article done by King5 is excellent in that it identifies yet another type of identity theft that can happen to any unsuspecting victim. Still, the way in which the fraud occurred I doubt anyone would be able to catch such a scheme even if they had performed reasonable research beforehand.
Think about it...As mentioned in the story, the (poor credit) buyer goes to escrow to sign papers only to have the (good credit)paperwork later substituted in order to close the loan. This kind of fraud doesn't get identified until long after the damage has been done.
The important element here is how these types of cases are handled in terms of making those accountable for the fraud committed. While certainly tragic to the victims, I don't expect much from our System initially. After all, unlike Realtors or Real Estate Appraisers for example, loan officers are not currently licensed in the State of Washington and given the large number of transactions in the State each year, this is a small percentage of the overall total.
Still, only with media exposure and decisive action against the perpetrators can this kind of abuse be eliminated.

My family and my relatives are friends with her. We are also friends with Liza Bautista's brother.
I have been in the mortgage business for 36 years. There seems to be several pieces missing in this original story.
1. Who signed as purchasers on the purchase and sales agreement that the lender reviewed and on which the closong agent closed?
2. Who was the purchaser on the title report that the investor and escrow company reviewd?
3. Who represented the closing agent at the signeing of the final papers?
4. Did the victims ever sign a note and deed of trust? Seems they just signed the original purchase and sale agreement, which immediately disappears, and then never participated again until they were handed the keys!!
5. There is a lot of misrepresentations that slipped through the final investors QC and this is hard to beleive with todays underwriting and quality controll criteria.
In any real estate transaction, where financing is involved, there are so many documents that confirm condinuity of information through out.
For this to even have a chance of succeeding, the real estate agent, broker, lender/investor and escrow/closing agent (whom the notory normaly represents)would have too be involved. Fifteen, twenty years ago it was very feasable to pull off, but today with all the computer links available to the lenders there must be more to this story than is now on the table.
This story should end in a legal prosecution of this unscrupulous Eliza aka Liza aka Lisa Bautista and she should make full monetary restitution to those she bilked.
She has made people paid a huge price for something not delivered, now it's her turn to pay a higher price (probably a jail time) for whatever she has done. That's about even, ha? I feel sorry not for her, but for her husband, family, relatives, friends and other acquaintances. I wish the authorities would have a close look-out for her that she might try to leave the country. seems that most of the people that had the houe in their name, probably signed something but didn't read it. I noticed that the people that had the homes in thier name where non-american. They probably didn't read what they where signing and because of this where taken advantage of....
just last week someone i know saw her and spoke with her. she said she had a house in federal way for rent. well, this house is under someone's name whose signatures were forged. she had the guts to say she owns that house. well, that house is already in foreclosure and the "owners" hired a lawyer to sue and help them clean up their credit.
from what i heard she does not think a lot of people know about the news. she does not think what she did was a big deal....and because she asked for forgiveness from the church members everything is must be ok now.

If you kept all your paperwork, correspondence, etc. Consult with a lawyer, and if you can prove damages, file a civil suit. Do something quick.

Ms. Bautista will be brought to justice by some of the honest mortgage companies she briefly worked for. These small local companies do good honest work but she has caused them destruction by leaving them with the mess that must be cleaned up. As a loan officer I know some of these companies are honest and do great things for their clients but Ms. Bautista and her accomplice Action Escrow may have caused these honest good companies demise and put some good honest people out of work. Their are so many victims in this case. I do know that these companies are doing what they can by working with King 5 news and the authorities to make sure Ms. Bautista gets whats coming to her.

I feel sorry for the owners and employees of the companies she worked for. One of the companies is being sued for an outrages amount of money and the company is small and has to go out of business. Its not fair that the people injured are just sueing everyone and not going after LIza and Action Escrow who where in cahoots to defraud mortgage brokers and the public. One of the owners is handicapped and may have to sell his house to pay for legal bills. He is the guy who helped the Department of Finacial Institutions and Susanna Frame investigate Liza. Her victims are not just the people who had their identity stolen. Their crdit can fixed but the employees and business owners she has destroyed will not be able to recover their losses.
